I recently acted for an education establishment who discovered that their course content had been copied wholesale by a competitor and was being sold online. An application for an urgent injunction was made to the High Court Business and Property Court, Intellectual Property List (CHD). Very soon after an initial appearance when the judge described the respondent’s defence as “an interesting take on copyright law” with a raised eyebrow, the respondent made an offer for damages and costs which was accepted.
